What is Sexual Violence and Harassment?

Let’s first identify what is sexual harassment. (Click here to learn more) Recently, the Ontario government brought forward Bill 132, the Sexual Violence and Harassment Action Plan Act, which, among other things, amends the Occupational Health and Safety Act ("OHSA"). Bill 132 follows upon the government’s campaign, launched in March 2015, “It’s Never Okay: An Action Plan to Stop Sexual Violence and Harassment.”

Sometimes sexual harassment can lead to sexual violence…

For example, the Lori Dupont case lead to the enactment of Bill 168 amending the OHSA to ensure a safe working environment for all employees. Ms. Dupont, a nurse at Hôtel-Dieu Grace Hospital was stabbed to death by her ex-boyfriend Marc Daniel, who worked there as an anesthetist. Dr. Daniel became obsessed with Ms. Dupont, pursuing her relentlessly, eventually persuading her to go out with him, and finally pressing her into moving in together. Ms. Dupont had applied for a peace bond to keep Dr. Daniel away from her and was waiting for a court date when he resumed working at Hôtel-Dieu in June that year. She was slain at the hospital during the morning shift on November 12, 2005, by Dr. Daniel. He later killed himself with a drug overdose.

Workplace harassment and workplace violence are often spoken of and treated in tandem. The case of Theresa Vince is an example of sexual harassment: a female worker targeted by the person she reported to, who raised the issue with her employer but who was unsuccessful in getting the harasser to stop. Tragically in her case, the sexual harassment eventually escalated to fatal violence. On June 2, 1996, Ms. Vince was shot to death in the Chatham department store where she had worked for 25 years. Her store manager Russell Davis then turned the gun on himself. Ms. Vince, a wife, mother and grandmother, was to retire from work at the end of the month.

When it is passed, Bill 132 will take effect either 6 months after the Act receives royal assent or on July 1, 2016.
