Bill 132 proposed amendments to OHSA will expand the meaning of workplace harassment under OHSA to include workplace sexual harassment. The definition of sexual harassment in Bill 132 mirrors that of the Human Rights Code:

engaging in a course of vexatious comment or conduct against a worker in a workplace because of sex, sexual orientation, gender identity or gender expression, where the course of comment or conduct is known or ought reasonably to be known to be unwelcome; or

making a sexual solicitation or advance where the person making the solicitation or advance is in a position to confer, grant or deny a benefit or advancement to the worker and the person knows or ought reasonably to know that the solicitation or advance is unwelcome.

When it is passed, Bill 132 will take effect either 6 months after the Act receives royal assent or on July 1, 2016.

Your best defence in the workplace is having a well-crafted policy and procedures, conducting training, meeting administrative fairness guideline when it comes to disclosure, confidentially, and when it is appropriate to hire a neutral third-party investigation firm when there are complaints of sexual violence and harassment.
